Apply for Spanish back tax

Irish residents who sold a Spanish property in 2005 and 2006 could recoup a substantial portion of the profits tax they paid. The deadline is running out for those who sold in 2005 as they need to apply before the ends of this year. This follows a landmark ruling by the European Court of Justice against the Spanish tax authority.

Prior to January 2007 the Capital Gains Tax (CGT) rate in Spain was 35pc for non-residents but only 15pc for residents. However the European Court ruled that this was discriminatory against non-residents.

Colm Murphy, director of Property Tax International, says that anyone who made a profit from selling a property during 2005 and 2006 and can prove their CGT payment to the Spanish tax authorities could have a legal case for a refund.
